Justice Crusader Mr Prabhakar Bagchand has launched Paralegalism and Strategic Human Rights Litigation a book authored by him in Garden of Dreams, Kathmandu today.
Speaking to Nepalyatimes after releasing his own book , Mr Bagchand said , I would like to dedicate this book to Paralegals who are the soul of Paralegalism. Mr Prabhakar Bagchand said , It is imperative to distinguish legal empowerment from traditional concept of legal aid. Traditional legal aid has, its limitations. legal aid provides temporary relief to the poor. It may be called as fire brigade or ambulance approach.
Traditional legal aid redresses particular instance of injustice but does not fundamentally change the structure that generates and sustains injustice. Traditional legal aid in fact makes people dependent. It prevents them from evolving into a self –reliant , inner directed, creative and responsible persons who think for themselves and act on their own initiatives.
In the context of inclusion of access to justice in Sustainable Development Goals, Paralegalism can be an effective means to achievement of the goal of human rights and justice. From the experiences of working with Paralegals I have realized progaramme on Paralegalism should have special thrust on justice. Paralegals are the barefoot doctors who work at the grass root level to cater to the needs of the poor . He said , legal empowerment has to be way out of poverty. Paralegals can play a crucial role achievement of SDG. Hence , a new breed of barefoot lawyers the Paralegals have to be created and integrated into every sector of the society.
Mr Bagchand further said, My attempt is to make the process of learning simple. This work is not at all scholarly in any way. I do not intend it to be one and I am not capable of writing one. As a justice crusader and somebody who believes in teaching for learning I lack the scholarly intellect. I am thus, conditioned to write in simple and straightforward manner. I have kept way from jargons, mystification and academic scholarship, my aim is to reach out to lay reader . I would be content if I am able to simply lives for people through this work , which is what Paralegalism is exactly for me.
Paralegalism is a collective dream that many justice crusaders, legal practitioners share the world over.
Mr Bagchand said it is only through knowledge of law and respecting and following the law a civilized society can be created. Hence, monopoly over knowledge of law has to be broken.
The book examines what Paralegalism and Strategic Human rights litigation is and how the two concepts can be interlinked. The book is published by Campaign for Promotion of Community Paralegalism in Nepal ( CPCPN).
